Terms of Use, Disclaimer & Policies

Last updated: . These Terms are a binding agreement between you and the operator of Chatveo (“Chatveo,” “we,” “us”). By accessing or using the service (the “Service”), you agree to all of the following, including the binding arbitration and class-action waiver in Section 16. If you do not agree, do not use the Service.

1. Eligibility

The Service is intended solely for adults aged 18 years or older (or the age of majority in your jurisdiction, whichever is greater). By using the Service you represent and warrant, under penalty of law, that you are at least 18 and have the legal capacity to enter into these Terms. Access by anyone under 18 is strictly prohibited.

2. Age Gate, Security Check & State-Law Compliance

Chatveo is a general-audience, SFW service that is not intended to display adult content, but access is restricted to adults. Before entering, you must affirm that you are 18 or older and agree to these Terms. We also use an automated security/bot-detection check (currently Cloudflare Turnstile) to deter automated access and abuse; by using the Service you consent to that check, which may process your IP address and limited technical data. Where the law of your state or jurisdiction requires formal age verification, you must complete any verification process we present, and you consent to it. You agree not to circumvent, falsify, or assist others in circumventing the age gate, security check, or any verification. We may block, restrict, or condition access by jurisdiction to comply with applicable law.

3. Child-Safety Policy — Zero Tolerance & Cooperation with Law Enforcement

We have absolute zero tolerance for child sexual abuse material (“CSAM”), grooming, enticement, or any sexual content, conduct, or solicitation involving a minor.

If we become aware of any content, account, communication, or conduct that we believe in good faith involves the sexual exploitation or abuse of a minor, we will:

By using the Service, you expressly consent to this preservation, reporting, and disclosure, and you waive any objection to it. There is no expectation of privacy with respect to conduct that endangers a child.

4. No Sexually Explicit Content

The Service is not a platform for pornography or sexually explicit conduct. Nudity, sexual activity, and sexually explicit performances are prohibited and will be removed, and offending users disconnected and banned. Because we do not permit or solicit sexually explicit visual depictions, we do not act as a "producer" of such depictions. We nonetheless reserve the right to retain records and verification data as needed to comply with 18 U.S.C. §§ 2257–2257A and other applicable law. You are solely responsible for any content you transmit.

5. Anti-Trafficking

We strictly prohibit, and have zero tolerance for, sex trafficking, commercial sexual exploitation, prostitution, and any conduct violating 18 U.S.C. §§ 1591 or 1595 (as amended by FOSTA-SESTA). Accounts and conduct implicating trafficking will be terminated, preserved, and reported to authorities.

6. Prohibited Conduct

You agree not to use the Service to: expose minors to the Service or transmit content harmful to minors; display, request, or transmit content that is illegal, obscene, pornographic, defamatory, infringing, invasive of privacy or publicity rights, harassing, threatening, abusive, hateful, or otherwise objectionable; harass, stalk, threaten, extort, or defame others; solicit money, goods, or personal information; engage in commercial or promotional activity without permission; impersonate any person or entity; record, screenshot, or redistribute another user without their consent; transmit malware or attempt to disrupt or reverse-engineer the Service; or violate any applicable law. We may remove content and suspend or terminate access at any time, for any reason, without notice.

7. User Content & Section 230

The Service is an interactive computer service that connects users directly for real-time video and text. Content is created and transmitted by users, not by us. Consistent with Section 230 of the Communications Decency Act (47 U.S.C. § 230), we are not the publisher or speaker of user content and are not responsible or liable for it. We are not obligated to pre-screen or monitor user content, though we may review, moderate, remove, or preserve it at our discretion. You may encounter content that is offensive, indecent, or objectionable, and you use the Service at your own risk.

8. Assumption of Risk

Interacting with strangers carries inherent risks. You are solely responsible for your interactions and for any information you choose to reveal. You knowingly and voluntarily assume all risk arising from your use of the Service, including exposure to other users' conduct or content.

9. Privacy, Data & Chat Retention

We collect and log limited technical data — including your IP address, connection metadata, timestamps, gender/preference selections, reports, and a randomly-generated guest identifier stored in your browser (used to reconnect you and to enforce these Terms). We use cookies for essential functions, including keeping you logged in (for Premium accounts) and recording that you passed the security check. Text-chat messages are recorded and retained for a limited period for safety, moderation, and legal-compliance purposes, and are associated with connection data such as IP addresses. Live video is transmitted peer-to-peer between users and is not recorded by us. We use third-party providers to operate the Service, including our hosting provider, a payment processor (Stripe) for Premium, and a bot-protection provider (Cloudflare), which may process your IP address and technical data. We may preserve and disclose data to comply with the law, respond to lawful requests, and protect safety — and, in the child-safety circumstances in Section 3, proactively and without legal process. By using the Service you consent to this collection, recording, and retention. Do not share sensitive personal information with other users.

10. Accounts

Chatting does not require an account; a free account is required only to purchase Premium. You agree to provide accurate information, keep your credentials secure, and are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or applicable law.

11. Premium & Billing

Premium is an auto-renewing subscription billed through our third-party payment processor (Stripe). By subscribing you authorize recurring charges until you cancel. You may cancel at any time, effective at the end of the current billing period; except where required by law, payments are non-refundable. Prices and features may change on notice. We do not store your full card details; they are handled by the processor.

12. Intellectual Property & DMCA

The Service, including its software, design, and branding, is owned by us and protected by law. We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512) and, where applicable, the EU Digital Services Act, and we terminate repeat infringers. 13. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any user is who they claim to be or is of any particular age.

14. Limitation of Liability

To the maximum extent permitted by law, we and our owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, revenue, goodwill, or for the acts, content, or conduct of any user or third party. Our total aggregate liability for any claim shall not exceed the greater of the amount you paid us in the 12 months before the claim or USD $100.

15. Indemnification

You agree to indemnify, defend, and hold harmless Chatveo and its owners, operators, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your interactions with other users, or your violation of these Terms or any law or third-party right.

16. Binding Arbitration & Class-Action Waiver

Please read carefully — this affects your legal rights. Except as stated below, you and we agree to resolve any dispute arising out of or relating to the Service or these Terms exclusively through final and binding individual arbitration, administered under the rules of a recognized arbitration provider, rather than in court. You and we waive the right to a jury trial and the right to participate in a class, collective, or representative action or class-wide arbitration.

Carve-outs. This Section does not apply to: (a) individual claims in small-claims court; (b) claims to protect intellectual property; and (c) any claim arising out of or relating to the sexual exploitation or abuse of a minor, sex trafficking, or CSAM, which are expressly excluded from arbitration and this class waiver. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms.

17. Governing Law & Venue

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. To the extent any dispute is not subject to arbitration, it shall be brought exclusively in the state or federal courts located in the State of Wyoming, and you consent to their personal jurisdiction and venue there.

18. General

We may modify these Terms at any time; material changes will be posted here and continued use constitutes acceptance. If any provision is held unenforceable, the remainder stays in effect. These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements. We may assign these Terms; you may not. Our failure to enforce a provision is not a waiver. To report abuse or a child-safety concern, use the in-app Report button or contact abuse@chatveo.live.
